In these terms and conditions, the site, website or the online store refers to broadbandmall.co.za (owned by Digi Max ICT Solutions). By placing an order with us you agree to our sales terms, conditions and policies.

Acceptance of Terms

By accessing the content of BroadbandMall, www.broadbandmall.co.za you agree to be bound by the terms and conditions set out herein and you accept our privacy policy, and any other business practices statements, and rules made on this website. If you object to any of the terms and conditions set out in this agreement, or any of the pages on the website listed above, you should not use any of the products or services on the Website and leave immediately.

You agree that you shall not use the Website for illegal purposes and will respect all applicable laws and regulations. You agree not to use the website in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the Website. You also agree not to compromise the security of the Website or attempt to gain access to secured areas or sensitive information.

You agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.


Modification
BroadbandMall reserves the right to change any part of this agreement without notice and your use of the Website will be deemed as acceptance of this agreement. We advise users to regularly check the Terms and Conditions of this agreement.

BroadbandMall has complete discretion to modify or remove any part of this site without warning or liability arising from such action.

Application of Terms & Customer Acknowledgment
These Terms constitute a binding contract between the Customer and BroadbandMall. The Customer acknowledges agreement and acceptance of these Terms by making a purchase, placing an order or otherwise shopping on our Website (the "Site"). These Terms are subject to change without prior notice.

Purchase Prices
Prices are listed on our Web site, and are subject to change without notice. There is currently no Value Added Tax applicable on any prices. The symbol (Inc) that follows the price in rand on this website is simply provided to indicate that you do not pay additional charges besides the indicated value, tax or other such charges.
 

Shipping; Risk of Loss
During working hours, orders are usually processed within 6-8 hours. However, please allow up to 24 to 48 hours for your order to be processed.
BroadbandMall will arrange payment for shipping with the carrier, but such costs are the responsibility of the Customer. BroadbandMall charges shipping and handling fees for every shipment, unless a special promotion or contract term provides otherwise; such cost includes the freight charged by the carrier, packaging, and handling.
We are not responsible for any loss/damage once the item has been shipped unless insurance has been purchased beforehand.
Delivery times are estimates only and we shall not be liable for any delays.
Payment is due before shipment, unless credit terms have been arranged in advance. No item will be shipped out until Proof of Payment has been emailed to info@broadbandmall.co.za.

Only a maximum of 3 days is allowable to complete order payment. Failure to do so will result in the order being cancelled.

Pricing Information; Availability; Errors and omissions Disclaimer
All pricing is subject to change. We reserve the right to make adjustments to pricing, products and service offerings for reasons including, but not limited to, changing market conditions, product discontinuation, product unavailability, manufacturer price changes and errors in advertisements.

All orders are subject to product availability. Therefore, we cannot guarantee that we will be able to fulfil customer's all orders.

We make every effort to ensure the accuracy of the information published on our website(s). However, the documents and graphics published on this site may contain technical inaccuracies or typographical errors. We make no representations about the suitability of the information and graphics presented on this site. All such documents and graphics are provided "as is" without warranty of any kind.

If an error is made and a product is listed at an incorrect price, we shall maintain the right to refuse or cancel any orders placed at the incorrect price. If the order has been confirmed and you have paid, we shall immediately issue a credit. We also do not guarantee that our prices listed on other web sites or price engines are accurate or up-to-date.

Limitation of Liability
NEITHER BROADBANDMMALL NOR ITS AFFILIATES WILL BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. NEITHER BROADBANDMALL NOR ITS AFFILIATES WILL BE LIABLE FOR PRODUCTS NOT BEING AVAILABLE FOR USE OR FOR LOST OR CORRUPTED DATA OR SOFTWARE OR THE PROVISION OF SERVICES BY THIRD PARTIES. THE CUSTOMER AGREES THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCTS OR SERVICES PROVIDED DIRECTLY BY BROADBANDMALL OR ITS AFFILIATES, NEITHER BROADBANDMALL NOR ITS AFFILIATES WILL BE LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE RAND AMOUNT PAID BY CUSTOMER FOR THE PRODUCT(S) OR SERVICE(S) GIVING RISE TO THE CLAIM. We will not be responsible for any delays in delivery which result from any circumstances beyond our control, including without limitation, product unavailability, carrier delays, delays due to fire, severe weather conditions, failure of power, labour problems, acts of war, terrorism, general insurrection, acts of God or acts of any government or agency.
We will not be held responsible for any typographical errors including instructions, descriptions, prices or terms.
We will not be held responsible for missing, damaged, or late package delivery by the shipper.

Orders; Payment Terms
Payment is due before shipment, unless credit terms have been arranged in advance. No item will be shipped out until Proof of Payment has been emailed to info@broadbandmall.co.za.
We allow a maximum of 3 days to complete order payment. Failure to do so will result in the order being cancelled.
 

Return of merchandise (RMA) and Warranty
We want you to be completely satisfied with your purchase. Therefore, we provide a 7 day money-back satisfaction guarantee on anything you purchase from BroadbandMall. You can return purchases with no questions asked for a refund.

All items are covered by a 12 month warranty which will be honored directly by BroadbandMall. All products will either be replaced/repaired/refunded depending on stock availability.

Please email us should you need to return an item.
We do not reimburse your fee to ship to us, but we will pay for return shipping if the item is faulty and is subject to replacement.
Generally, refunds are subject to inspection of item(s) and all returns are subject to a 20% handling fee for items in returned in original condition. BroadbandMall reserves the right not to accept returns for electronics whose original packaging has been opened as the product may not be salable. Other terms and conditions may also apply depending on the specific product supplier's return policy and applicable return fees. Contact us with respect to your specific return requirement.

Please re-package safely and include all original product packaging before sending back.
BroadbandMall reserves the right to refuse a refund if the item is damaged from misuse, items are missing, or if the product is altered in any way.

BroadbandMall or its sister websites are not responsible for damage or loss of any kind that may occur as a result of using or misusing any product purchased from us.


Privacy and Security
BroadbandMall respects your personal privacy as such any information about you, your email address, your purchases, etc. is kept confidential and not given or sold to any third party for any reason (unless requested by a court order or by the government office).  This includes all personal information supplied during your estrangement with BroadbandMall.
